The history of the fisheries regime includes several particularly interesting features. One of the key factors in the agenda setting, at least for one important actor, was less a concern for conservation of straddling and highly migratory fish stocks than it was Canada’s desire to overcome the EU’s ability to determine its own catch levels in the Grand Banks fishery. In the original negotiations two different veto coalitions—the like-minded caucus of coastal states and the major distant-water states—initially opposed key provisions of the regime. The US shift from veto state to lead state proved a major factor in overcoming the resistance of the two veto coalitions and gave greater impetus to the adoption of innovative conservation measures. And the willingness of Canada to use physical force on the high seas in its dispute with the EU, with the result that the EU agreed to onboard inspectors on the high seas, helped put the issue of boarding and inspecting in a different light for key veto states. Finally, the refusal to ratify the agreement by some of the main fishing states (such as Chile, China, and Peru, to name a few), continues to impede the regime’s effectiveness.
